principal, Darren Noble,

for insureds. With that experience,
he knows the domestic building
insurance scheme inside out.
Our solicitor, Alan Bidychak,
is also well placed to advise

having spent 3 years with
Vero Insurance in both the
claims and recovery areas.
The firm has a great
track record in preparing and prosecuting
insurance claims to private insurers
and the Victorian Managed Insurance Authority
(formerly the Housing Guarantee Fund).
We also act
for builders who may wish to challenge
an insurer’s decision or a direction
by the VMIA under the House Contracts
Guarantee Act. We recently defended
a claim by the VMIA against a builder
seeking to recover an amount paid by
it to a developer in satisfaction of
a claim. The VMIA directed the builder
to pay that sum into the Domestic Building
(HIH Indemnity) Fund and when it did
not, the VMIA sued the builder in VCAT.
However, VCAT found that VMIA did not
have the power to give such a direction
to the builder and its claim was dismissed
with costs.
